i guess the FCC could catch you, but it's doubtful. for years someone who isn't me ran modified HF ham rigs on the CB outbands (below1 and above 40), from both mobiles and bases, while using high power. at that time i think Uncle Charley actually had $$ to throw at scofflaws. never had a problem, and either did anyone i knew doing the same thing. i've heard of people getting fined, but most were either causing interference all over the place or running 1000s of watts.
on the other hand hamsters are more likely to turn each other in. but then again many outbanders have HAM tickets but find it more fun on the illegal freqs.
